This is to award a 90-day time and materials general fund purchase order for $250,000.00 to Johnson Controls Fire Protection, LP using OGS bid prices. The work entailed will be the 2022 mandatory in-depth fire alarm system inspections and service in every school building.

The 90-day window is to provide time for the District to seek a more cost effective means to provide this service and remain in compliance with NYS law. Th e$250,000 amount is to guarantee compliance I for the fall school opening.

In 2010 Simplex Grinnell (Simplex) won the bid for this work at $236,160.00 and from 2011 to 2020 District annually engaged Simplex at a typical cost of $196,000.00.

In 2020 Simplex was purchased and taken over by Johnson Controls (JCI) who agreed to continue in 2021 at the cost of $196,305.00. However, JCI submitted a proposal for 2022 for $587,406.77. JCI claims that is was because the old awarded price was seriously deficient and they could not renew at that old price.

Despite District efforts to procure a proposal for in a timely manner, JCI did not submit the 2022 proposal until June 3, six business days before 2021 agreement expired.

Resolution: Ladies and Gentlemen:

WHEREAS: the District is required to maintain operational fire alarms and ancillary equipment, and

WHEREAS: such service is available for procurement from Johnson Control, under New York State Office of General Services Contract No. PT68816, Group 77201, Award No. 23150 for the 2022-2023 school year, and

WHEREAS: in accordance with General Municipal Law the administration recommends such procurement under this contract,

NOW THEREFORE BE IT RESOLVED: That the award for the “Fire Alarm Inspection, Service and Maintenance” be made to Johnson Controls Fire Protection LP 1399 Vischer Park Ferry Crescent RD, Clifton Park, NY 12065 under NYSOGS Contract PT68816 in an amount not to exceed $250,000.00 for a term of 90 calendar days
