Rationale: This is to award a Purchase Order as referenced above as per the attached emergency declaration issued by the Superintendent on October 19, 2020. Bids are not required under an emergency declaration.

Castlton, under contract to the New York State Department of Environmental Protection (DEP) was working with the City of Yonkers Fire Dept and the DPW in their attempts to locate and clean-up a fuel oil leak found in and around Crestwood Lake and local sewers. On October 18 they were able to trace the leak to a failed fuel pump in the 1951 boiler room at School 29. Upon finding the source, the DEP transferred the responsibility for Castlton’s expenses to the District. The District dismissed Castlton in favor of Luzon Environmental Services, already under contract with the District.

The cost for Castlton’s services are $27,160.18 based on time and material prices in force under the DEC’s contract. Further expenses include replacement absorbent filtering booms for the City Fire Dept at an additional cost of $320.00 for a cost total of $27,480.18.

Resolution: Ladies and Gentlemen:

WHEREAS: Castlton Environmental Contractors, LLC, under contract with the New York State Department of Environmental Conservation (NYSDEP) and in cooperation with the City of Yonkers Fire Department and Department of Public Works responded to reports of leaked fuel oil in and around the Crestwood Lake and local sewers, and

WHEREAS: the source of the contaminant was found to a failed oil pump in the 1951 boiler room of School 29, and

WHEREAS: the District responded to the site immediately wherein the NYSDEP informed the District it was most favorable to the District the District absorb the costs to date for Castlton’s services, and

WHEREAS: Castlton was dismissed at the end of business on October 18th with costs to that point of $27,480.18, and

WHEREAS: An Emergency Declaration was issued on October 19, 2020 for Westchester Hills School 29 “Fuel Oil Spill Cleanup”, and

NOW THEREFORE BE IT RESOLVED: That a Purchase Order be issued to Castlton Environmental Contracting, LLC PO BOX 609, Nanuet, NY 10954 for tracing and initial cleanup of the fuel oil spill originating from Westchester Hills School 29 for $27,480.18 for term of 180 calendar days.
