Rationale: This resolution is to grant the administration the authority to enter into the subject contract as per the attached emergency declaration issued by the Superintendent on October 19, 2020. Bids are not required under an emergency declaration.

Sometime in the afternoon or evening of October 16, 2020 a fuel oil pump on the #3 boiler at Westchester Hills School 29 failed and began leaking No. 2 fuel oil. . The spill flowed through the local sewer systems and into the watershed of Troublesome Brook and Crestwood Lake.

Castlton Environmental under contract to the New York State Department of Environmental Conservation (NYSDEC) was working with the City of Yonkers Fire Dept and the DPW in their attempts to locate and clean-up a fuel oil leak found in and around Crestwood Lake and local sewers. On October 18 they were able to trace the leak to a failed fuel pump in the 1951 boiler room at School 29. Upon finding the source, the DEC transferred the responsibility for Castlton’s expenses to the District. The District dismissed Castlton in favor of Luzon Environmental Services, already under contract with the District.

Luzon responded the site within hours of being contacted and took over the sizable cleanup operations under the District contract. This work was overseen by the NYSDEC and COY Fire Department which continued through mid-December. The final cost is to be tabulated but will not exceed $350,000.00.

Resolution: Ladies and Gentlemen:

WHEREAS: sometime in the afternoon or evening of October 16, 2020 a fuel oil pump on the #3 boiler at Westchester Hills School 29 failed and began leaking No. 2 fuel oil, and

WHEREAS: the leak was traced back to School 29 on October 18, 2020 after an extensive investigation and containment efforts by the New York State Department of Environmental Conservation (NYSDEC), the City of Yonkers Fire Department and Department of Public Works, and

WHEREAS: the containment and clean-up operations were transferred from the NYSDEC contractor to the District whereby the District engaged Luzon Environmental Services, already under contract to the District to work with the NYSDEP and the COY Fire Dept to further contain and clean-up the spill, and

WHEREAS: an emergency declaration was issued by the Superintendent of Schools on October 19, 2020 to have this work completed in the most timely manner and in compliance with the NYSDEC, and

WHEREAS and Luzon Environmental Services, responded to this spill and their price to contain the spill is a not to exceed $350,000.00 for term of 180 calendar days, and

NOW THEREFORE BE IT RESOLVED: that a purchase order be issued to Luzon Environmental Services, 1246 Glenn Wild Road, Woodbridge NY 12789 for the cleanup of the fuel oil spill at Westchester Hills School 29, for $350,000.00 for term of 180 calendar days.
