Rationale:
|
This work is being done under an emergency declaration issued on October 29, 2019. This is to contain a fuel oil spill, conduct immediate remediation, file all paperwork with governing agencies and replace the existing failed tank and appurtenances.
The corrective work was designed and overseen by Eisenbach & Ruhnke Engineering, P.C. Site work was originally anticipated to be completed in April 2020 but due to primarily to an unexpectedly higher amount of soil remediation and the effects of the COVID19 pandemic the work could not be completed as scheduled.
Added time is required of E&R to ensure that the increased remediation work and filing with the NYSDEC and the WCDOH are in compliance. This is an upset estimate. Actual hours use will be billed against and not to exceed this amount. The fees charged for enhanced construction administration are less than that anticipated from a third party construction management arrangement. This is the second amendment. The first merely transferred this assignment to a new contract number with no changes to the terms.

Ladies and Gentlemen:
WHEREAS: via Resolution 15.24 on January 22, 2020, the Board of Trustees, assigned Eisenbach & Ruhnke Engineering, P.C. to professional engineering services for CIP10883 “Emergency Removal and Replacement of the Heating Oil Tank” at Roosevelt High School under contract 617107 in the amount of $50,800.00 for a term of 365 calendar days, and
WHEREAS: via Resolution 15.15 on February 26, 2020, the Board of Trustees authorized the award of Contract 2020-0594, Architectural/Engineering to Eisenbach & Ruhnke Engineering, P.C. in response to RFP404 “On-Call Architectural Services” for an amount not to exceed $1 million, a term of 3 years, , and
WHEREAS: Via Resolution 15.3 on July 15, 2020, the Board of Trustees reassigned the task for CIP10883 from the expiring contract to contract 2020-0594 for Eisenbach & Ruhnke Engineering, P.C., effectively replacing Contract 617107, and
WHEREAS: additional work as defined under that contract is required of Eisenbach & Ruhnke, P.C. to complete CIP10883, “Emergency Removal and Replacement of the Heating Oil Tank” at Roosevelt High School in an amount not to exceed $30,000.00 increasing the fee of this task form $50,800 to 80,800 with no change in the term, and
NOW THEREFORE BE IT RESOLVED: That the Superintendent of Schools is hereby authorized to amend the existing assignment to Eisenbach & Ruhnke Engineering, P.C., 291 Genessee Street, Utica, NY 13501 to provide additional construction services for CIP 10883 “Emergency Removal and Replacement of the Heating Oil Tank” at Roosevelt High School in the amount of $30,000.00 increasing the fee from $50,800.00 to $80,800 for a term of 365 days under contract 2020- 2020-00000594, “On-Call Architectural Services for the School Facilities Management Department”
