Rationale: As required Yonkers Public Schools is requesting approval to AWARD RFB6514- SUPPLEMENT transportation services (categories 1, 2, 4 & 6)- Regular Big Bus, Special Education In & Out of District and Athletics to First Student, Phillip Trans and VP BUS (due to the nationwide drivers shortage).
Funding: Amount not to exceed: $9,413,170
First Student Inc: increase existing contract $457,730
Phillip Trans: increase existing contract $4,667,000
VP Buses: increase existing contract $4,288,440

Resolution: WHEREAS, the following is contingent upon the lowest responsible bidders complying with Section 112 of the City Code of the City of Yonkers regarding Hack licenses and all other requirements of RFB6514-SUPPLEMENT; and

WHEREAS, the Yonkers Public Schools Board of Education wishes to increase the exiting contracts due to the nationwide drivers shortage to First Student Inc (increase existing contract $457,730.00) Phillip Trans (increase existing contract $4,667,0000)
VP Buses (increase existing contract $4,288,440). As the mentioned vendors on resolution to provide Regular Big Bus, Special Education In & Out of District and Athletics transportation services for the 2021-22 SY with the option to extend,

WHEREAS, the following is contingent upon the Yonkers Public Schools' actual utilization of the aforementioned line items and transportation services; and WHEREAS the district administration has designed in conjuction with First Student, Phillip Trans and VP BUS as mentioned above on resolution, a service which meets the objectives set forth by the Board.

Now therefore be it resolved: the Board of Education hereby authorizes the Superintendent of Schools to enter into agreements with First Student, Phillip Trans and VP BUS in a total amount not to exceed $9,413,170 depending on special education transportation services which includes door to door van services with a bus monitor, wheelchair accessible vans (if applicable) and general education big bus services (including sports activities) and be awarded from September 1, 2021 through June 30,2022 with the option to extend.

And, be it further resolved that in accordance with the terms and conditions of the contracts awarded, routes may be added, routes may be deleted, routes may be otherwise modified, or routes may be extended, if required and such modifications are hereby approved on condition that no such modification may exceed ten percent (10%) of the contract price set forth without prior approval of the Board of Education. And be it further resolved that the Yonkers Board of Education authorizes the Superintendent of Schools to enter into transportation contract negotiations and agreements for the 2021-22 SY including for both public and private/parochial school students.

It is acknowledged and agree that pursuant to the terms of that certain inter municipal agreement by and between the City of Yonkers Board of Education ("BOE") and the City of Yonkers (the "City") as filed in the Office of the City Clerk on June 16, 2014 the terms of this agreement are subject to review and revision by the Corporation Counsel, as well as approval by the City's Board of Contracts and Supply. Furthermore, this agreement shall not be enforceable until signed by all parties and approved by the Corporation Counsel's Office.
