Rationale: To approve a Settlement Agreement and Release resolving improper practice charge against the District with the Public Employment Relations Board (“PERB Charges”)
Funding:
Resolution: WHEREAS, the Yonkers Federation of Teachers (“YFT”) filed an improper practice charge against the District with the Public Employment Relations Board pursuant to the New York State Civil Service Law; and,

WHEREAS, the District answered the improper practice charge and denied all allegations therein; and,

WHEREAS, the YFT was represented by counsel; and,

WHEREAS, in lieu of proceeding with a formal PERB hearing, the Parties agree to enter into this Settlement Agreement and Release (“Agreement”); and

WHEREAS, the Agreement has been negotiated between the Superintendent of Schools and the YFT, subject to approval by the Board of Education, which Agreement sets forth the terms of settlement of the PERB Charges; and,

WHEREAS, the Board of Education has had an opportunity to review the terms of the Agreement, and finds that the terms are fair, reasonable and appropriate under the circumstances; and,

NOW, THEREFORE, BE IT RESOLVED, that the Board of Education hereby approves the Agreement, as negotiated and made between the Superintendent of Schools, the YFT and Employee #341856; and,

BE IT FURTHER RESOLVED, that the Superintendent of Schools and those under his direction take all steps necessary to effectuate and implement the Agreement, made between the Superintendent of Schools and the YFT.
