Rationale:
|
This resolution is to authorize the Superintendent of Schools to extend the subject contract one calendar year as per provisions for a limit of two annual extensions under mutual consent of both parties under the same terms and conditions of the original contract for up to two years. This will be the final extension for WBE FENCE 11 Deer Court, Brewster, N.Y. 10509
This is an on-call, service as needed or requirements contract. The vendor performs only as directed by the District. Roughly $160,000 per year was expensed in 2015, 16 and 17. Budget constraints cut this to $49,000 in 2018 and 2019. In 2020 this was cut again, awarding only $20,000.00 worth of funding for this work which will be limited to emergency repairs. We intend to keep this amount the same for this year.

Ladies and Gentlemen:
WHEREAS: bids were solicited and opened in public on August 31, 2018 in compliance with General Municipal Law 103 for bid no 6337 ““Fence Installation and Repair”, and
WHEREAS: Board Item 15.21 dated Dec. 19, 2018 was approved awarding contract 2019-0549 to WBE Fence Company, Inc. 11 Deer Court, Brewster NY 10509 in the amount of $49, 210.00 for a term of 356 calendar days, and
WHEREAS: bid specifications provide for annual extensions by the mutual consent of both parties under the same terms and conditions of the original contract for up to two years, and
WHEREAS: such provisions were invoked to extend the contract for one year and restrict the amount available to $20,000.00 under the first amendment via Res 15.21 on Jan. 22, 2020 revising the contract amount to $69,210.00 and extending the term to 730 calendar days, and
WHEREAS: the Administration recommends a second amendment increasing the contract amount by $20,000 and extending the term another 365 calendar days.
NOW THEREFORE BE IT RESOLVED: That the Superintendent of Schools is hereby authorized to amend contract 2019-549 for “Fence Installation and Repair” with WBE Fence Company, Inc., by $20,000.00 to a revised contract amount of $89,210.00 and the term to 1,095 calendar days
