Rationale: The District has been leasing space in this building since 1995. As part of the Lease Agreement, the District is responsible for certain extra costs, not built into the “base rent” as “additional rent”. This includes but is not limited to servicing and repairs to the elevator, any repairs needed as a result of the District’s and interest on overdue payments.
This resolution is to authorize the payment of the subject PO for such charges under the “additional rent” clause incurred over the past 2 years primarily that of the elevator, a sewer blockage (shared cost) and interest. Please that this was heavily negotiated down from a claim more than twice that amount.

Resolution: Ladies and Gentlemen:
WHEREAS: this lease was most recently modified and extended by the Board via Resolution No. 16.20 on December 16, 2015, and
WHEREAS: the has provisions for “additional rent” to cover the cost to the landlord for servicing at and repairs to the elevator, any repairs needed as a result of the District’s actions and interest on overdue payments, and
WHEREAS: the District has negotiated an agreement to pay $19,666.00 in “additional rent” for such costs incurred by the landlord since the fall of 2018.
NOW THEREFORE BE IT RESOLVED that the Board of Trustees authorizes the Superintendent of School s to issue a PO for “additional rent” for the District Warehouse at 201 Saw Mill River Road to the landlord 201 Saw Mill River Road Development Corp., in amount of $19,666.00 increasing Contract 614640 PO 2020-0112 from $977,500.00 to $997,166.00 with no change in term.
