Rationale:
This is to formalize with the Board the above contract. Work was started under the emergency declaration “Procurement of Goods & Services for COVID19 Response” issued by the Superintendent on July 27, 2020 and last amended on December 10, 2020.

Under the EMDEC bids and formal notifications such as resolutions are not required to start, execute and pay for the work. However contract PO2021-0313 with Milcon was put in place immediately with the initial amount available at $150,000. It has since been amended to a final total amount of $1,480,000.00.

The work was limited to District-directed GC work in support of HVAC improvements optimizing ventilation in response to the pandemic. Work was done on either a time and materials basis or negotiated lump sum fee for specialized and well defined work.

Milcon has an excellent history with the District, has demonstrated that they were capable and ready to make such improvements under District terms and conditions.

The 18 schools involved included: 5, 13, 14, 18, 21, 22, 23, 24, 28, Cornell, Palisade Prep, Boyce Thompson, Dodson, ML King, Gorton, Lincoln, Roosevelt and YMHS. The scope of work includes but is not limited: to asbestos abatement, duct cleaning, access openings for duct work, roof restoration at HVAC equipment, cleaning & encapsulating surfaces in air handling units and new interior finishes for abated and/or otherwise disturbed surfaces.

Resolution
Ladies and Gentlemen;

WHEREAS: an Emergency Declaration was issued on July 27, 2020 for “Procurement of Goods & Services for COVID19 Response”, and

WHEREAS: this Emergency Declaration was last amended on December 10, 2020, and

WHEREAS: in implementing its COVID crisis response the District has great need for General Contracting services under for “On-Call HVAC Restoration, and ”

WHEREAS: Milcon Construction Corp., has been solicited to provide such services under negotiated unit prices and have an established and acceptable history with the District, demonstrated that they were capable and ready to make such improvements under District terms and conditions, and

WHEREAS: Milcon has completed work in the amount of $1,480,000.00, and

NOW THEREFORE BE IT RESOLVED: that the Superintendent of Schools is hereby authorized to formally award CAPITAL PO2021-0313 for CIP 10901 “COVID19 Related HVAC Improvements” Districtwide under Emergency Declaration to Milcon Construction Corp., 142 Dale Street, Babylon, NY, 11704 in the amount of $580,000.00 increasing the final amount to $1,480,000.00.
