Rationale: As per the legislation titled, Lead Testing in School Drinking Water, Subpart 67-4 of Title 10 of the Codes, Rules and Regulations of New York State, all school districts and Boards of Cooperative Educational Services will be required to complete the second round of lead testing of all water outlets used for drinking and cooking. The first round of sampling took place in 2016. This next round of water sampling must be completed by December 31, 2020.
RFP 423A for the subject project was issued on April 8, 2020. Responses from 8 firms were received on April 29, 2020. As a result of the examination of the responses, it was determined that H2M would be the best firm suited for this project although LIRO provided a lower proposal fee at $185,200. H2M is better suited to this task having considerably more experience in this area.
Under GML 104b such services are not required to go to the lowest price but to the best qualified for the task.
This is for third party control of the lead in water project. H@M will be required to provide the planning, design, survey, inventory, record-keeping and data organization of the 2020 Lead Testing in School Drinking Water as well as remediation oversight so that the District will meet the requirements of the above legislation. H2M’s tasks include but are not limited to: potable outlet inventory auditing, protocol administration, chain of custody control, record keeping, reporting, implementation of subsequent remediation plan, field work and third-party plumbing oversight.
Via Resolution 15.15, at their stated meeting on February 26, 2020, the Board of Trustees awarded H2M a capital funded contract #2020-00000629 for on-call Architectural/Engineering Services for an amount not to exceed $1 million each over a period of three years.
Funding: 450.5150.100000.1620.B2300 General Fund (FY21 for the cost of testing)
Resolution: Ladies and Gentlemen:
WHEREAS: under Resolution 15.15 at the stated meeting on February 26, 2020, the Board of Education authorized the award of a requirements based, professional Architectural/Engineering services contract to H2M Architects & Engineers, in response to District RFP404 “On-Call Architectural Services for the School Facilities Management Department” for an amount not to exceed $1 million, and
WHEREAS: work as defined under that contract is required for the 2020 Lead Testing in School Drinking Water, 10-NYCRR Subpart 67-4, and
WHEREAS: the response by H2M Architects & Engineers to a request for proposals issued by the Facilities Department was deemed most advantageous to the District at a cost not to exceed $217,907.90,
NOW THEREFORE BE IT RESOLVED: That the Superintendent of Schools is hereby authorized to appoint H2M Architects & Engineers, 538 Broad Hollow Road, 4th Floor East, Melville, NY 11747 to the task of providing engineering services for the district wide 2020 Lead Testing in School Drinking Water, in compliance with New York Legislation 10-NYCRR Subpart 67-4, in an amount of $217,907.90 for a term of 365 calendar days.
NOW THEREFORE BE IT RESOLVED: That the Superintendent of Schools is hereby authorized to appoint H2M Architects & Engineers, 538 Broad Hollow Road, 4th Floor East, Melville, NY 11747 to the task of providing Environmental engineering services for the district wide Lead in Drinking Water Remediation program, in compliance with 10-NYCRR Subpart 67-4, in an amount of $217,907.90 for a term of 365 calendar days.
