Rationale: This resolution is to authorize two actions: the first is to increase the contract amount for Change Order 2 and the second is to extend the contract by another year.

Change Order 2 is for an amount not to exceed $43,483.20 in capital funds to replace major components of the YMA PA system which is on the verge of collapse and cannot be repaired due primarily to its age and scarcity of parts. This is CIP10906 “New Public Address System” at Yonkers Montessori Academy which will be paid based upon actual hours worked and wholesale prices/markups of parts installed. The above amount is consider to be an upset figure, not to be exceeded.

This contract provides a means to extend by mutual consent of the parties two additional years under the same terms and conditions as originally awarded which is being hereby invoked for the second time.

Original award was by Res 18.9 at the Nov. 20, 2018 meeting. The first amendment was for Change Order 1 increasing the contract by $9,000.00 via Res. 18.12 on Dec. 18, 2019. The second amendment extended the contract for the first time via Res. 16.4 on Nov.20, 2019. This third amendment will provide for the Change Order 2 and the said extension.

Resolution: Ladies and Gentlemen:

WHEREAS: bids were publicly solicited and opened August 31, 2018 in compliance with General Municipal Law 103 for bid no 6313 “Repair Clocks, Intercoms, and PA systems”, and

WHEREAS: Board Item 18.9, dated Nov. 20, 2018 was approved awarding a contract to Symbrant Technologies 16 Commerce Drive, Farmingdale NY 11735 in the amount of $89,000.00 for a term of 365 calendar days, and

WHEREAS: funding for additional work in the amount of $9,000.00 was provided under the first amendment Res 18.12 on Dec. 18, 2019 revising the contract amount to $98,000.00, and

WHEREAS: bid specifications provide for annual extensions by the mutual consent of both parties under the same terms and conditions of the original contract for up to two years, and

WHEREAS: such provisions were invoked to extend the contract for one year under the second amendment via Res 16.4 on November 20, 2019 revising the contract amount to 187,00.00 and extending the term to 730 calendar days, and
