Rationale:
|
This resolution is to grant the administration the authority to enter into the subject contract as per the attached emergency declaration issued by the Superintendent on September 23, 2020. The first phase of the project has been completed and includes oil transfer, installation of temporary tank, tank cleaning, subsurface investigations and the design and the procurement of the replacement tank which due on site in March. Work remaining includes removal and replacement of the 68 year old 10,000 gallon single wall steel tank with a new double wall fiberglass tank, connecting piping, fuel pump set, electronic tank monitoring system and site restoration. Soil borings, sampling and testing indicate that little if any contaminated soil is anticipated but this will not be fully known until the excavation is completed. The work was designed by Eisenbach & Ruhnke Engineering, P.C for building permits and to procure SED building aid for the project. Luzon Oil Company in the past has successfully completed District capital projects. E&R has provided a letter of recommendation to award. Construction is anticipated to commence on or about March 1 and be complete by May 1, 2021.

Ladies and Gentlemen; WHEREAS: An Emergency Declaration was issued on September 23, 2021 “Emergency Replacement of Underground Fuel Oil Storage Tank” at School 16, and WHEREAS: Under this emergency declaration the District solicited Luzon Oil Company, Inc to contain the spill and perform immediate remediation work, and WHEREAS: the District has a substantial successful history with Luzon Oil Company, Inc., and WHEREAS: Luzon is already under contract with the District, and WHEREAS: time constraints preclude the use of standard design, bid, build required under GML103, and WHEREAS: the quote submitted has been duly examined and as a result of this examination of the quote submitted, the administration has determined that Luzon Oil Company, Inc., proposal is acceptable at a proposal amount not to exceed $362,212.45 for a term of 365 calendar days. NOW THEREFORE BE IT RESOLVED: That the Superintendent of Schools is hereby authorized to award contract for CIP 10905 “Emergency Removal and Replacement of the Heating Oil Tank” at School 16 for an amount not to exceed $362,212.45 to Luzon Oil Company, Inc., (dba) Luzon Environmental Services, P.O Box 1070, Woodridge NJ, 12789. For a term of 365 calendar days.
