Rationale:
|
This is to approve change order 1 for CIP 10933, Contract 2022-0771 “Replace Underground Fuel Oil Storage Tank” at Kahlil Gibran School with Luzon Environmental for $180,075.00 increasing the contract from $389,710.00 to $569,785.00 and extending the contract term for an additional 180 days for paperwork purposes. This work is being done under the Emergency Declaration issued by the Superintendent on November 24, 2021. A change order is a written agreement between the District and its contractor to change a building construction contract. They add to, delete from, or otherwise alter the work and/or progress schedule in the contract bid documents. CO’s are caused by any of three situations that can arise on a project: unforeseen conditions, design errors, omissions, and owner directed extra work. During construction, the scope of drainage and restoration work expanded due to the unanticipated state of the storm sewers and the extent of the excavations required to complete all work. This included piping, retaining wall, stairs, sidewalks, fencing, backstop, and team benches. The restoration is a major improvement on the pre-existing configurations and conditions in the vicinity of building, field and parking lot. A total of 4 change orders out of which two were rejected and the other two for owner directed restoration work $173,250.00 and unforeseen drainage issues $6,825.00. All work is being fully aided.

Ladies and Gentlemen: WHEREAS: On or about November 24, 2021 an Emergency Declaration for “Kahlil Gibran School Underground Fuel Oil Storage Tank Replacement” with an estimated cost of $400,000.00 was issued by the Superintendent of Schools, and WHEREAS: By Resolution 15.13 dated March 16, 2022 the Board of Trustees authorized the award of Contract 2022-0771 “Emergency Declaration Underground Fuel Oil Storage Tank Replacement” at Kahlil Gibran School for $389,710.00 and a term of 365 calendar days, and WHEREAS: in the course of executing the contracted work it was determined that additional work is required at the additional cost of $180,075.00 increasing the contract amount from $389,710.00 to $569,785.00 and the term to 545 calendar days. NOW THEREFORE BE IT RESOLVED: That the Superintendent of Schools is hereby authorized to issue change order 1 to Contract No. 2022-0771 “Emergency Declaration Underground Fuel Oil Storage Tank Replacement” at Kahlil Gibran School to Luzon Environmental, Inc., P.O. Box 1070, Woodridge NJ, 12789 in the amount of $180,075.00 increasing the contract amount from $389,710.00 to $569,785.00 and extending the contract to 545 calendar days.
